"Nisi prius (also called court of original jurisdiction) is a Latin phrase translated to “unless before” in English, and the term refers to disputes from a trial court or lower court in American law. Nisi prius cases are to be contrasted with those in a court of appellate jurisdiction that reviews decisions from the lower court. The modern American use of nisi prius stemmed from the term referring to local trials in England."
"The question at issue is, Are the respondents in this case entitled to hold the office of Trustees of the General Assembly of the Presbyterian Church in the United States of America? . . . The secondary issue . . . is, whether that body which elected these relators, was truly the General Assembly of the Presbyterian Church. If you are satisfied of this fact, it will of course be your duty to render a verdict for the relators." ["The relators in this case claim to be legal trustees."]: p. 268.
